Terms of Use

BY REQUESTING THE FREE GUIDE FROM, AND/OR SCHEDULING A FREE DISCOVERY SESSION WITH, ODYSSEYS INTO WELLBEING YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS. PLEASE READ THEM CAREFULLY.

1. You are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. By provided your mailing address, you consent to receive communications from us via United States Mail.

2. Odysseys into Wellbeing (“OiW”) will keep your information private, and will not share it with any third party unless compelled to do so by law.

3. You understand and acknowledge that the role of OiW and its owners, employees and agents is not to prescribe or assess micro- and macronutrient levels; provide health care, medical or nutrition therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, OiW is a mentor and guide whose professionals have been trained in holistic health coaching to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes. You understand and acknowledge that neither OiW nor its owners, employees or agents is acting in the capacity of a doctor, licensed dietician-nutritionist, psychologist or other licensed or registered professional, and that any advice given by OiW and/or its owners, employees and agents is not meant to take the place of advice by such professionals. If you are under the care of a health care professional or currently use prescription medications, you should discuss any dietary changes or potential dietary supplements use with your doctor, and should not discontinue any prescription medications without first consulting your doctor. You understand and acknowledge that the information received through the OiW website and OiW created documents, electronic and otherwise, text, scripts, graphics, interactive features and the like (collectively, “OiW Material”), should not be seen as medical or nursing advice and is not meant to take the place of the opinions of licensed health professionals.

4. You expressly assume the risks of trying new foods or supplements and the risks inherent in making lifestyle changes. You release OiW and its owners, employees and agents from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which you ever had, now have or will have in the future against OiW, its owners, employees and/or agents, arising from your past or future participation in, or otherwise with respect to, the OiW Material.

5. The design of the OiW Material is owned by OiW, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. The OiW Material is provided to you AS IS for your information and personal use only. OiW reserves all rights not expressly granted in and to the OiW Material. You agree to not engage in the use, copying, or distribution of any of the OiW Material other than expressly permitted herein.

6. Subject to your compliance with these Terms of Service, OiW hereby grants you permission to use the OiW Material, provided that, other than expressly permitted herein: (i) your use of the OiW Material as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the OiW Material, or in any other manner inconsistent with these Terms of Service; (ii) you will not duplicate, transfer, give access to, copy or distribute any part of the OiW Material in any medium; (iii) you will not attempt to reverse engineer, alter or modify any part of the OiW Material; and (iv) you will otherwise comply with the terms and conditions of these Terms of Service.

7. In order to request the free “10 Self-Care Strategies: Restore Your Health, Rejuvenate Your Career” guide, you acknowledge and agree that you will have to provide OiW with your electronic mail address. In order to request a free Discovery Session, in addition to your electronic mail address, you acknowledge and agree that you will have to provide OiW with your mailing address and telephone number. You expressly acknowledge and agree that OiW may periodically contact you regarding its services and promotions.

8. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc. or "load testers" such as wget, apache bench, mswebstress, httpload, blitz, Xcode Automator, Android Monkey, etc., that accesses the OiW Material in a manner that sends more request messages to OiW’s servers in a given period of time than a human can reasonably produce in the same period by using OiW Material, and you are forbidden from ripping the content unless specifically allowed. Notwithstanding the foregoing, OiW grants the operators of public search engines permission to use spiders to copy materials from the website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. OiW reserves the right to revoke these exceptions either generally or in specific cases. While we don't disallow the use of sniffers such as Ethereal, tcpdump or HTTPWatch in general, we do disallow any efforts to reverse-engineer our system, our protocols, or explore outside the boundaries of the normal requests made by OiW clients. We disallow using request modification tools such as fiddler or whisker, or the like or any other such tools activities that are meant to explore or harm, penetrate or test the site. You must secure our permission before you measure, test, health check or otherwise monitor any network equipment, servers or assets hosted on our domain. You agree not to collect or harvest any personally identifiable information from OiW or the OiW Material, nor use the OiW Material for any commercial solicitation or spam purposes. Except as permitted herein, you agree not to spam, or solicit for commercial purposes, any users of OiW Material.

9. IN NO EVENT SHALL OiW, ITS OWNERS, EMPLOYEES OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OiW MATERIAL, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OiW MATERIAL AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA ANY OiW MATERIAL, AND WHETHER OR NOT OiW IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND/OR (VI) THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OF SERVICE OR PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. OiW IS NOT RESPONSIBLE OR LIABLE IN ANY MANNER FOR ANY THIRD PARTY MATERIALS POSTED ON OR IN CONNECTION WITH THE OiW MATERIAL, WHETHER POSTED OR CAUSED BY OiW, BY THIRD PARTIES OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN CONNECTION WITH THE OiW MATERIAL.

10. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OiW DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, IN LAW OR FROM A COURSE OF DEALING OR USE OF TRADE, AS TO ANY MATTER, INCLUDING THOSE OF MERCHANTABILITY, SATISFACTORY QUALITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OiW MATERIAL WILL MEET ALL OF YOUR REQUIREMENTS, OR THAT THE USE OF THE OiW MATERIAL WILL BE UNINTERRUPTED OR ERROR-FREE. THE OiW MATERIAL IS PROVIDED TO YOU ON AN "AS IS" BASIS AND YOUR USE OF OiW MATERIAL IS AT YOUR OWN RISK. THE PARTIES EXPRESSLY ACKNOWLEDGE THAT THE DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS AGREEMENT AND THESE TERMS OF SERVICE. 11. IF YOU ARE DISSATISFIED WITH OiW OR THE OiW MATERIAL, OR THESE TERMS OF SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE OiW MATERIAL. 12. You agree to defend, indemnify and hold harmless OiW , its owners, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) your use of and access to the OiW Material; (ii) your violation of any term of these Terms of Service; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms of Service and your use of the OiW Material. 13. Without limiting other remedies, we may limit, suspend or terminate our service and specific user accounts, prohibit access to the OiW Material, delay or remove hosted content, and take technical and legal steps to keep users off the OiW website if we think that such users are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of these Terms of Service or OiW’s policies. Additionally, we may, in appropriate circumstances and at our discretion, suspend or terminate accounts of users who may be repeat infringers of these Terms of Service and/or the intellectual property rights of third parties. We also reserve the right to cancel unconfirmed accounts, or accounts that have been inactive for a long time, or to modify or discontinue providing any part of the OiW Material.
